Red Bull challenges Redwell brewery over name

Red Bull has written to Norwich-based brewer Redwell, requesting it immediately withdraws its trademark application, claiming the names are too similar and would confuse customers.

Red Bull employs 9,000 people, while the Norwich brewer has just eight staff, but Red Bull decided it was a threat and in a letter from its Austria headquarters it said Redwell’s application “comprises Red Bull’s earlier trademark ‘red’ as a whole, which is a prima facie for the similarity of signs”.

It adds: “Moreover, all trademarks consist solely of English words and contain the common element ‘red’. The term ‘well’ is merely descriptive and therefore of no distinctive character at all.

“Furthermore the term ‘bull’ and the term ‘well’ share the same ending and just differ in two letters.

“The ending ‘ll’ is identical and therefore the terms Red Bull and Redwell are confusingly similar from a visual as well from a phonetical point of view.”

Redwell called it an over-the-top reaction and said it simply named itself after Redwell Street in Norwich. It will try to appease Red Bull without changing its name.

Few things can bring communal pleasure so intimately as wine. Apart from a hot tub, perhaps. Sport can trigger mass jubilation, film gives us shared empathy, but wine has a nigh-unique ability to bestow conviviality among us through a shared bottle – which makes it especially galling that we spend so much time divided over it.
